Some information on Intellectual Property and Copyright

Please note that the following questions and answers are designed to help raise awareness of Intellectual Property (IP) and copyright in Singapore and are by nature not a complete discussion or substitute for legal advice.

  2. Where can I find more information about the copyright law in Singapore?

  3. What would SingNet do if a copyright owner requests for information on its subscribers who may have committed copyright infringement?

    SingNet has a right to protect the rights of our customers while adhering to the legal system. We reject requests from third parties for information pertaining to our customers. Such information is only released under a court order or if requested by the law enforcement or regulatory agencies.

    Copyright owners have a right to protect their Intellectual Property and we urge our customers to comply with copyright and other Intellectual Property laws.


  4. What should I do if a copyright owner comes after me for alleged copyright infringement?

    ISPs like SingNet cannot step into commercial disputes between copyright owners and customers. We are also not in a position to judge the legal merits of such cases. It is important that customers seek necessary legal assistance to understand their legal rights and to protect their interests.


  5. What would SingNet do if copyright owners issue take-down notice?

    SingNet adheres to the relevant rules pertaining to take-down notices. Upon receipt of a valid take-down notice in accordance with the Act, SingNet will take reasonable steps, where technically possible, to remove or disable access to the material.

    After removing or disabling access to the material, SingNet will take reasonable steps to notify the person who may have posted the material ("Respondent") and provide such Respondent with a copy of the relevant take-down notice.

    If the Respondent sends a valid and proper counter-notice in accordance with the Act, SingNet will take reasonable steps to restore the material if it is technically and practically feasible to do so, provided always that SingNet will not restore any such material in instances where the copyright owner has commenced legal proceedings to prevent the restoration thereof and SingNet is informed of the same.


  6. How would a copyright owner know that copyright materials have been infringed?

    Copyright owners may have their own applications or resources that can track copyright infringement on the Internet.

    In general, Internet activities can be seen as coming from a source IP (Internet Protocol) address. This usually forms the basis for further investigation.

    Peer-to-Peer (P2P):
    For example, copyright owners may collect information identifying your computer through the file sharing network that you were connected to. When you are downloading from others or sharing your files in the file sharing network, your IP address might be visible to them. Content shared over file sharing programs can cause problems.

    Under the Copyright Act, copyright owners have the exclusive right of communication and to make their works available to the public. P2P users who share copyrighted items not belonging to them infringe this right. Those who access and download such items also violate the traditional reproduction right.

    Please do not download files you know or suspect to be copyrighted material.


  7. My computer is shared in the family. How do I know if someone has installed file-sharing software in my computer?

    If you are running Windows:
    • Click the 'Start' button, select 'Settings', then select 'Control Panel'
    • Select the 'Add/Remove' programs icon
    • Look through the 'Currently Installed Programs' list box (for popular peer-to-peer programs to look out for in your computer, please see Question 8)

  9. How do I uninstall file sharing programs in Windows 2000?

    Most applications have their uninstall option and/or instructions; please follow them.
    • Otherwise, most Windows program would have the following instructions:
    • Click the 'Start' button, select 'Settings', then select 'Control Panel'
    • Select the 'Add/Remove' programs icon
    • Select the program you wish to uninstall from the 'Currently Installed Programs' list box (for popular P2P programs to look out for in your computer, see Question 8)
    • Click the 'Change/Remove' button
    • Select the 'Automatic' option
    • Click 'Next' then 'Finish'
